Terms of Service

Welcome to Uistea Cloud. These Terms of Service ("Terms") govern your access to and use of the Uistea Cloud website, services, and applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Use of Service

1.1. Eligibility

You must be at least 13 years old to use the Service. By agreeing to these Terms, you represent and warrant to us that: (a) you are at least 13 years old; (b) you have not previously been suspended or removed from the Service; and (c) your registration and your use of the Service is in compliance with any and all applicable laws and regulations.

1.2. License to Use

Subject to these Terms, Uistea Cloud grants you a non-transferable, non-exclusive, revocable, limited license to use and access the Service solely for your own personal or internal business use. The Service is designed for the temporary hosting and sharing of files.

2. User Content and Prohibited Conduct

2.1. Your Content

You are solely responsible for the files, text, and other content ("User Content") that you upload, share, or store on Uistea Cloud. You represent that you own or have the necessary rights to all User Content you upload.

2.2. Prohibited Content

You strictly agree NOT to use the Service to upload, post, transmit, or otherwise make available any content that:

• Is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or invasive of another's privacy.
• Contains child sexual abuse material (CSAM) or exploits children in any way. We strictly report such content to relevant authorities like NCMEC.
• Infringes upon any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
• Contains software viruses, malware, trojan horses, or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware.
• Promotes terrorism, hate speech, or violence against individuals or groups.

2.3. Enforcement

We reserve the right to investigate and prosecute violations of any of the above to the fullest extent of the law. We may involve and cooperate with law enforcement authorities in prosecuting users who violate these Terms. You acknowledge that Uistea Cloud has no obligation to monitor your access to or use of the Service, but has the right to do so for the purpose of operating the Service and ensuring compliance with these Terms.

3. Service Availability and Termination

3.1. Temporary Storage

You acknowledge that Uistea Cloud is an ephemeral storage service. Files are deleted automatically based on the retention period (e.g., 24 hours, 7 days) or download limits selected at the time of upload. We are not responsible for any loss of data resulting from this automatic deletion process.

3.2. Modifications

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

3.3. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

4. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. UISTEA CLOUD MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

5. Limitation of Liability

IN NO EVENT SHALL UISTEA CLOUD, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

6. DMCA and Copyright

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes the copyright or other intellectual property infringement ("Infringement") of any person. If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through the Service, please contact us.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
